Kerepehi Buyer Privacy Notice
This notice explains how we collect, use, share and look after your personal information when you enquire about, or buy, a home in the Kerepehi development on McGowan Avenue, Kerepehi, Hauraki District. We follow the Privacy Act 2020 and its Information Privacy Principles.
Who we are
The Kerepehi homes are marketed by Devlin Property, on behalf of the developer and vendor. In this notice “we”, “us” and “our” mean Devlin Property and the developer and vendor of the Kerepehi homes. We are responsible for the personal information you give us through the Kerepehi page.
Privacy Officer: Matt Devlin, Managing Director, Devlin Property
To contact the Privacy Officer, use the enquiry form on the Kerepehi page and say your message is a privacy request, or reply to any email we have sent you.
What we collect
- When you enquire: your full name, email address and phone number; which describes you best (first-home buyer, homebuyer, downsizer, investor or real estate agent); the lot and colour scheme you’re interested in; how you heard about us; the name of any agent or adviser; what you’d like us to do (for example, send the brochure or book a call); and whether you’d like project updates.
- If you decide to buy: the details needed to prepare the sale and purchase agreement and complete settlement. This includes your full legal name, postal address, the details of your lawyer and lender, and any identity information that we or our lawyers must collect by law.
- When you talk to us: notes of our calls, emails and site visits with you.
You don’t have to give us your information. If you don’t complete the required fields, we won’t be able to reply to your enquiry.
Why we collect it
We use your information to:
- reply to your enquiry and send you the brochure, lot availability and sale agreement summary;
- arrange calls and site visits;
- prepare and carry out a sale and purchase agreement if you buy, and keep you updated through construction, code compliance, settlement and after you move in;
- send you Kerepehi project updates, only if you ticked the updates box. Every update email comes from Devlin Property and has an unsubscribe link, and we action unsubscribes within 5 working days;
- improve how we market and sell the Kerepehi homes; and
- meet our legal obligations.
We don’t use your information for unrelated purposes, and we never sell it.
Who we share it with
We use trusted service providers to operate our website and manage enquiries.
If it’s needed, we also share your information with:
- our lawyers, including the lawyer whose trust account holds your deposit;
- the builder, surveyors and Hauraki District Council, for consents, construction, code compliance and titles;
- your lawyer and lender, if you buy;
- a licensed real estate agent, if you tell us one introduced you; and
- anyone we’re required to share it with by law.
How long we keep it
- Enquiries that don’t lead to a purchase: we delete or anonymise them within 24 months of our last contact with you, or sooner if you ask.
- Purchaser records: we keep them for as long as we need them for the sale, the building warranties and our legal record-keeping obligations.
- If you unsubscribe: we keep only your email address and the date you opted out, so we don’t contact you again.
Keeping it safe
We take reasonable steps to protect your information from loss, misuse and unauthorised access. Only people who need it to do their job can access it.
Your rights
You can ask to see the personal information we hold about you, and ask us to correct it if it’s wrong. You can also ask us to delete it, unless we need to keep it by law or to complete a purchase. Contact our Privacy Officer through the enquiry form (say it’s a privacy request) or by replying to any email from us. We’ll respond within 20 working days, free of charge.
Complaints
Please contact our Privacy Officer first. If you’re not satisfied with our response, you can complain to the Office of the Privacy Commissioner at privacy.org.nz or on 0800 803 909.
